Understanding the Difference between Legal and Physical Custody

One of the most important decisions parents have to make when they go their separate ways is how to share custody of their child. Before making this decision, it’s crucial to understand the two different types of custody:  Legal Custody and Physical Custody.

While there is no presumption with physical custody like there is with legal custody, Utah generally prefers that parents share physical custody of their children. However, joint physical custody does not often mean equal parent time and one parent is generally deemed the primary custodial parent despite the other having joint physical custody. There are also circumstances that warrant one parent having sole physical custody.
